Use of the Service
You may use the Service for your personal use and lawful purpose only.
You may not:
Use the Service to transmit any material (by uploading, posting, email or otherwise) that intentionally or unintentionally violates any applicable local, state, national or international law or any rules or regulations including limitation material that is threatening, abusive, tortuous, harassing, defamatory, libelous, obscene, invasive of another’s privacy or hateful;
Use the Service to transmit any unsolicited commercial e-mail or unsolicited bulk email (a.k.a. spam) or uses deliberately misleading headers in e-mails sent to multiple parties;
Use the Service to transmit any material by (uploading, posting, e-mail or otherwise) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
Use the Service to access or attempt to access the accounts of others, or to penetrate or attempt to penetrate security measures of PeaceHealth or any other computer software, hardware, electronic communications system or telecommunications system, whether or not resulting in disruption of service or the corruption or loss of data.
No Warranties
PEACEHEALTH EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES FOR THE SERVICE. THE SERVICE IS PROVIDED ON AN “AS IS BASIS”, WITHOUT WARRANTIES OF ANY KIND, INCLUDING ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, COMPLETENESS, RELIABILITY OR OF ERROR-FREE (OR UNINTERRUPTED) OPERATION EXCEPT FOR THOSE WARRANTIES REQUIRED BY LAW.
Assumption of Risk/Limitation of Liability
The entire risk arising out of use of the Service remains with you. Should the Service prove to be defective in any respect, you and NOT PeaceHealth shall assume the entire cost of any correction, service or repair to your laptop or other computing or communication device. No liability or cause of action shall arise from the Service not meeting your needs. PeaceHealth shall not be liable for any claims arising directly or indirectly from use of the Service. PeaceHealth shall not be liable for any damages including direct, indirect, punitive, special, incidental or consequential damages arising from use of the Service.
